Terms and Conditions

Terms of Business:

All orders placed by you (the company/person named on the order), with us (First Fix Fasteners Ltd, registered in England with number 09585634) do business with you under the following terms and conditions:

 

Basis of Sale and Service

Sales literature, web sites, price lists and other documents issued by the Supplier in relation to the Goods and Services are subject to alteration without notice and do not constitute offers to sell the Goods which are capable of acceptance. No contract for the sale of the Goods and Services shall be binding on the Supplier unless the Supplier has issued a quotation which is expressed to be an offer to sell the Goods and Services or has accepted an order placed by the Customer.

Any typographical, clerical or other accidental errors or omissions in any sales literature, quotation, price list, acceptance of offer, invoice or other document or information issued by the Supplier shall be subject to correction without any liability on the part of the Supplier.

 

The Goods

The specification for the Goods shall be that set out in the Supplier’s sales documentation, however Illustrations, photographs or descriptions whether online or in catalogues, brochures, price lists or other documents issued by the Supplier are intended as a guide only and shall not be binding on the Supplier.

No order submitted by the Customer shall be deemed to be accepted by the Supplier unless and until confirmed in writing by the Supplier’s authorised representative.

 

Ordering & Pricing

First Fix Fasteners Ltd offers goods for sale via www.1stfixfasteners.com, email and by telephone.

Prices are subject to change due to promotions either on-line, in catalogues / flyers or at tradeshows, the price shown on the website is the price to be listed in the Supplier’s invoice. The Supplier reserves the right, by giving written notice to the Customer at any time before delivery or provision, to increase the price of the Goods and/or Services to reflect any increase in the cost to the Supplier which is due to any change in delivery dates, quantities or specifications for the Goods and services which are requested by the Customer, or any delay caused by any instructions of the Customer or failure of the Customer to give the Supplier adequate information or instructions.

Any purchases or orders of goods made by you are subject to these terms and conditions and seen as legally binding.

Charges for packaging and transport will be clearly noted at the check-out screen online or noted in additional quotations. The price is exclusive of any applicable value added tax unless otherwise noted.

 

Payment

Orders placed on our website must be paid for at checkout, your order will only be accepted and then processed if payment is made in full. We accept most debit and credit cards. We can provide credit accounts to companies buying bulk on a business to business basis and subject to separate terms and conditions, contact us for more information.

Invoices shall be sent to the Customer at the point of dispatch of the goods.

All payments shall be made to the Supplier as indicated on check-out screen or email proforma issued by the Supplier.

 

Delivery

The Delivery Date is approximate only and time for delivery can vary. We can deliver to almost any part of the UK using a national carrier and in most case’s you will receive your order within 48 hours from dispatch The Goods may be delivered by the Supplier in advance of the Delivery Date upon giving reasonable notice to the Customer. We may use details given to us at the point of order to contact to keep you informed of delivery progress.

Customers based in some areas may see a slight delay in receiving orders, while more remote areas such as the Highlands it can be several days longer. We do offer options for quicker delivery where possible. These will be charged at a rate visible to you at the point of checkout online. Quicker delivery options may not be available in your area, contact us for more information.

 

Returns, Refunds and Cancelled Orders

Refunds and replacements can only be issued if, the goods are returned within a 14 day period from receipt.

Customers are required to pack goods for return in such a way they arrive back to us safely and in original packaging.

A copy of proof of purchases must be returned with the goods.

Shipping costs are non-refundable in the case of unwanted goods or items ordered in error.

Customers may also be required to pay associated shipping fees when returning an order.

All refunds must be made using the method of payment you used. You will receive your refund within 14 days of your return being received.

Faulty Items can be returned at no charge but must be approved by us prior to return and by a carrier of our choosing.

We do not accept returns on any made to order products.

We may offer a replacement or repair for any faulty goods that develop a fault after 30 days following delivery, if we are unable to repair any item we will offer with same or equivalent model.

You can contact us to cancel you order up-to the point of dispatch, however we do process orders as quickly as possible so please contact us by phone and check and if possible we will cancel your order.

 

Warranty

The tools we sell come with a manufacturer’s warranty, guarantee or similar. If you are non-trade, a consumer then these are in addition to your legal rights. Any complaint, query or claim under a manufacturer’s warranty, guarantee or similar assurance must be made direct to the manufacturer and we do not have any responsibility or liability under or in connection with any such warranty, guarantee or assurance.

Used, Ex-Demonstration models come with a 30 day warranty.

 

Availability

All products are subject to availability. While set out to ensure we have enough inventory to meet all orders/purchases if we are out of stock to complete your order, we will process any part of the order available and use details provided at the point of order to contact you on how to proceed with any lines that are out of stock. You may choose a refund or alternative item of equal value.

 

Liability

First Fix Fasteners Ltd will not by reason of any representation, implied warranty, condition or other term, or any duty at common law or under express terms of these Terms and Conditions, be liable for any loss of profit or any indirect, special or consequential loss, damage, costs, expenses or other claims (whether caused by the Supplier’s servants or agents or otherwise) which arise out of or in connection with the supply of the Goods and Services.

 

Force Majeure

First Fix Fasteners Ltd shall not be liable for any failure or delay in performing their obligations where such failure or delay results from any cause that is beyond the reasonable control of that Party. Such causes include, but are not limited to: power failure, Internet Service Provider failure, industrial action, civil unrest, fire, flood, storms, earthquakes, acts of terrorism, acts of war, governmental action or any other event that is beyond the control of the Party in question.

Law and Jurisdiction

These Terms and Conditions and the Contract (including any non-contractual matters and obligations arising therefrom or associated therewith) shall be governed by, and construed in accordance with, the laws of England and Wales.

Any dispute, controversy, proceedings or claim between the Parties relating to these Terms and Conditions or to the Contract (including any non-contractual matters and obligations arising therefrom or associated therewith) shall fall within the jurisdiction of the courts of England and Wales.
